Section 04

No-refund policy — Core clause

NO-REFUND CLAUSE — DIGITAL CONTENT / IMMEDIATE DELIVERY

PropSim delivers digital software whose execution begins immediately upon payment confirmation, with the buyer's express consent. The buyer therefore waives the standard 14-day withdrawal right under EU Directive 2011/83/EU (Art. 16(m)) and French Consumer Code (Art. L221-28 12°).

Accordingly: all payments are final and non-refundable, whether for a monthly subscription or a Lifetime purchase, once Premium access has been activated.

This policy reflects the nature of the service:

Single exception: In the event of total, documented technical failure attributable to PropSim (service inaccessible for more than 72 consecutive hours), a prorated credit or partial refund may be granted at PropSim's sole discretion, upon written request submitted within 7 days of the incident at [email protected].

Chargebacks: PropSim will systematically contest any Stripe dispute initiated by a user who accepted these Terms at checkout. Evidence of acceptance (timestamp, IP address, user ID) will be submitted to Stripe. A fraudulent chargeback may result in permanent account suspension.

Section 05

Cancellation

Monthly subscription: Cancel anytime via the Stripe customer portal. Cancellation takes effect at the end of the current billing period — no partial refund is issued for the remaining time.

Lifetime access: Permanent by nature. Access cannot be revoked by PropSim except in cases of breach of these Terms (fraud, abusive chargeback, unauthorized sharing of credentials).

Termination by PropSim: PropSim reserves the right to suspend or terminate access without refund in cases of fraud, Terms violation, attempted reverse engineering, or unauthorized resale of access.

Section 06

Limitation of liability

PropSim is a statistical tool. It does not constitute investment advice or a guarantee of trading results.

In accordance with Art. 1231-3 of the French Civil Code, PropSim's maximum aggregate liability in any circumstance is strictly limited to the total amounts paid by the user in the 30 days preceding the incident giving rise to the claim. PropSim cannot be held liable for indirect, incidental, or consequential damages, including loss of trading opportunity or loss of profits.

Section 07

Personal data (GDPR)

PropSim collects the following data as data controller (responsable de traitement) within the meaning of EU Regulation 2016/679 (GDPR):

Data is processed on the legal bases of contract performance (Art. 6(1)(b) GDPR) and legitimate interest (Art. 6(1)(f) GDPR). Data is not sold or transmitted to third parties except Supabase (authentication and database infrastructure) and Stripe (payment processing), both operating under GDPR-compliant data processing agreements.

In accordance with Arts. 15 to 22 GDPR and Arts. 38 to 43 of the French Data Protection Act (Loi Informatique et Libertés), users have the right to access, rectify, erase, port, and restrict processing of their personal data. To exercise these rights, contact: [email protected]. Users also have the right to lodge a complaint with the CNIL (cnil.fr).

Section 08

Consumer mediation

In accordance with Arts. L616-1 and R616-1 of the French Consumer Code, PropSim has designated a consumer mediator (médiateur de la consommation) to whom any unresolved dispute may be submitted free of charge:

DESIGNATED MEDIATOR

Médiateur du Numérique
Website: mediateur-du-numerique.fr

Before referring a dispute to the mediator, the user must first attempt to resolve it directly with PropSim by sending a written complaint to [email protected]. PropSim will respond within 30 days. If no satisfactory resolution is reached, the user may then contact the mediator within one year of the initial written complaint.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Section 09

Governing law and jurisdiction

These Terms are governed exclusively by French law, without regard to conflict of law principles.

In the event of a dispute, the parties agree to first seek an amicable resolution within 30 days following a written notice sent to [email protected]. If no agreement is reached, the dispute shall be submitted to the exclusive jurisdiction of the Tribunal compétent du ressort de Paris (75015), which is the court of the seller's registered office.

For consumers domiciled in an EU member state other than France, the mandatory protective provisions of their country of residence shall apply alongside French law, without prejudice to the above.

Section 10
